MBH 214 - Fundementals of Criminal Procedure Law

The aim is to help students become familiar with the fundamental principles and concepts of criminal procedure law, to understand the procedural foundations of the investigation and prosecution stages, and to determine the scope of application of criminal procedural rules. It also seeks to enable students to analyze the application of protective measures by understanding their characteristics, to classify types of evidence and determine their procedures, and to analyze the duties, powers, and responsibilities of procedural actors. Furthermore, it aims to ensure that students recognize special procedural rules, classify available legal remedies and list their conditions, and develop a knowledge-based reasoning ability regarding how each procedural actor may act during different stages of criminal proceedings.The main objective of the course is to enable students to develop a legal perspective in everyday situations, to distinguish between what is lawful and unlawful within criminal proceedings, to identify the procedural requirements of the process, and to find the theoretical and legal basis for procedural questions and problems encountered in practice.

Fundamental concepts of criminal procedure law, its function, aims, relationship with other disciplines, historical development, sources, principles, and scope of application, as well as the stages of investigation and prosecution, protective measures, subjects of proceedings and their duties, powers and responsibilities, special procedural rules and legal remedies, will be examined on a theoretical basis and in light of positive law, with reference to practice and case law perspectives.
