Course Objectives
Transferring analytical skills to interpret the basic principles of administrative justice and the legal rules in this field by assimilating the principle of the rule of law.
Course Content
The Administrative Jurisdiction course begins by discussing the emergence and development of administrative judiciary and its difference from other judicial systems. In this context, the importance and purpose of judicial review of the legality of the administration is discussed. The administrative justice system in Turkey and the basis of this system in the Constitution are explained in detail. In the rest of the course, the structure and duties of the administrative judiciary are discussed. The functions of the Council of State, regional administrative courts, administrative courts and tax courts, as well as the powers and responsibilities of these courts, are discussed. Additionally, the administrative judiciary's compliance with the principles of independence and impartiality is evaluated.Administrative case types are examined through basic case types such as annulment cases and full jurisdiction cases. The characteristics of these types of cases, acceptance conditions and opening processes are explained practically. In particular, the legality control of the administrative action in annulment cases and the trial process of compensation claims in full jurisdiction cases are detailed. The procedural rules of administrative proceedings also constitute an important part of the course. In this context, litigation deadlines, preparation of lawsuit petitions, implementation of court decisions and appeal processes are discussed in detail. The rights and obligations of the parties in the trial, as well as the role of the administrative judiciary in ensuring the balance between the public interest and individual rights, are emphasized. In the following sections of the course, the relationship between the administrative judiciary and the constitutional judiciary is discussed. The right to individual application to the Constitutional Court and the effects of this right on administrative procedures are analyzed. At the end of the course, current problems in administrative justice, reform proposals and electronic trial processes are discussed, enabling students to address the subject from a contemporary perspective.

Within the scope of this course, political parties, freedom of expression and association, freedom of religion and conscience, constitutional judiciary, independence of the judiciary, right to a fair trial, social rights and the regime of limitation of fundamental rights and freedoms, the emergence and development of the constitutional judiciary, the European Court of Human Rights and the Venice Commission. General information will be given about the standards set by international bodies; Subjects such as the structure and basic functions of the legislative, executive and judicial bodies will be introduced to students within the framework of basic principles.
