MBH 108 - Fundemantals of Administrative Law

The aim of this course is to convey to students the structure of the state as well as state-individual relations in a concrete way, in the light of classical administrative law theories, new understandings in doctrine, changes in legislation and new examples from judicial decisions.

The Administrative Law course begins by discussing the definition of administrative law, its subject and its relationship with other branches of law. In this context, the main principles that dominate administrative law and general concepts such as the structure and functioning of the administration are emphasized. The distinction between central administration and decentralization, the functioning of the general administration organization, provincial organization and local governments are examined in detail. In the following sections of the course, legal procedures of the administration are discussed. In this context, the legal nature and functions of unilateral administrative acts, regulatory acts and administrative contracts are evaluated. In addition, the consequences of unlawful transactions, the concepts of annulability and nonexistence are explained. The legal status of public officials, the concept of public servant, appointment and dismissal processes, and the rights, obligations and disciplinary penalties of public officials are emphasized. Within the scope of the responsibility of the administration, cases of faulty and perfect liability of the administration and ways for individuals to file a lawsuit against the administration are detailed.

Within the scope of this course, political parties, freedom of expression and association, freedom of religion and conscience, constitutional judiciary, independence of the judiciary, right to a fair trial, social rights and the regime of limitation of fundamental rights and freedoms, the emergence and development of the constitutional judiciary, the European Court of Human Rights and the Venice Commission. General information will be given about the standards set by international bodies; Subjects such as the structure and basic functions of the legislative, executive and judicial bodies will be introduced to students within the framework of basic principles.
