Course Objectives

Within the scope of this course, political parties, freedom of expression and association, freedom of religion and conscience, constitutional judiciary, independence of the judiciary, right to a fair trial, social rights and the regime of limitation of fundamental rights and freedoms, the emergence and development of the constitutional judiciary, the European Court of Human Rights and the Venice Commission. General information will be given about the standards set by international bodies; Subjects such as the structure and basic functions of the legislative, executive and judicial bodies will be introduced to students within the framework of basic principles.

Course Content

The content of this course includes: definition of constitutional law, methodology and resources, definition of the concept of constitution, binding nature and superiority of the constitution, hierarchy of norms, types of constitutions, constitutionalism movements, supremacy of the constitution and constitutionality control of laws, primary constituent power, secondary constituent power, concept of state, state. elements, theories about the origin of the state, state forms: monarchy - republic and unitary state - composite state, government systems, democracy, elections, fundamental rights and freedoms, Ottoman constitutional developments, constitutional developments in the republic period, The basic principles of the 1982 Constitution, fundamental rights and freedoms in the 1982 Constitution, legislative body, executive body, judicial body, constitutional jurisdiction and constitutional amendment issues are included.
